These Terms of Service (“Terms”) govern your access to and use of Nightset, including the Nightset mobile application, related websites, subscriptions, features, services, content, notifications, coaching insights, household features, and support services (collectively, the “Service”).
Nightset is operated by GoldasDust Global Inc. (“Nightset,” “we,” “us,” or “our”).
By downloading, accessing, creating an account, subscribing to, or using Nightset, you agree to these Terms. If you do not agree, do not use the Service.

1. What Nightset Does
Nightset helps users reduce late-night screen use, build healthier sleep routines, manage wind-down schedules, receive sleep-related insights, and, where enabled, coordinate household bedtime routines.
Nightset may include features such as:
Scheduled wind-down routines
App and category shielding through Apple Screen Time-related frameworks
Night Score, streaks, levels, and points
Wake-time reminders and alarms
Soundscapes or guided wind-down content
AI-generated coaching insights
Premium and Household subscriptions
Family or household bedtime coordination
Parent-managed Lights Out controls
Child-device wake settings and heartbeat/check-in alerts
Analytics, subscription management, and advertising attribution
Nightset is a wellness and productivity tool. It is not a medical device, clinical sleep treatment, emergency service, or substitute for professional medical, psychological, psychiatric, or sleep-health advice.
2. Eligibility
You may use Nightset only if you can legally agree to these Terms and are not prohibited from using the Service under applicable law.
If you are under the age of majority in your location, you may use Nightset only with permission from a parent or legal guardian.
If you use Nightset on behalf of a child, family member, household, organization, or other person, you represent that you have the legal authority and consent required to do so.
3. Accounts
Some Nightset features require an account. You agree to provide accurate information and keep your account information current.
You are responsible for:
Maintaining the confidentiality of your login credentials
All activity under your account
Keeping your device secure
Not sharing access in a way that violates these Terms

4. Account Deletion
If Nightset allows account creation, you may request account deletion through the app where available or by contacting:
Deleting your Nightset account is intended to delete your account record and associated personal data from Nightset systems, subject to legal, tax, accounting, fraud prevention, security, subscription, dispute-resolution, and operational exceptions.
Important: deleting your Nightset account does not automatically cancel an active Apple App Store subscription. To avoid future charges, you must cancel your subscription through Apple.

5. Subscriptions, Trials, Billing, and Renewals
Nightset may offer free features, paid subscriptions, free trials, promotional offers, offer codes, Premium plans, Household plans, and other paid features.
Subscriptions may include access to features such as AI coaching, expanded soundscapes, advanced insights, streak features, household controls, family bedtime tools, and other premium functionality.
If you purchase a subscription through Apple, billing is handled by Apple through your Apple ID. Nightset does not receive your full payment card details from Apple.
Subscriptions may automatically renew unless canceled before the end of the current billing period. Your subscription terms, renewal date, price, trial period, and cancellation options are shown by Apple before purchase.
You are responsible for reviewing subscription details before confirming purchase.

Unless you cancel before the trial ends, your subscription may automatically renew as a paid subscription through Apple.
Promotional offers may be limited by eligibility, geography, subscription status, App Store rules, or other conditions.
7. Nightset Points, Streaks, Rewards, and Offer Codes
Nightset may include points, streaks, levels, bonuses, or rewards to encourage consistent routines.
Nightset Points, streaks, levels, and similar features:
Have no cash value
Are not property
Are not transferable
Cannot be sold
Cannot be exchanged for money
May be changed, limited, reset, corrected, suspended, or discontinued
May depend on app availability, device state, permissions, and technical systems

8. Screen Time, Shields, and Device Controls
Nightset uses Apple Screen Time-related frameworks and device permissions to help apply app or category shields during wind-down periods.
You understand that these features may depend on:
Apple’s FamilyControls, ManagedSettings, DeviceActivity, and related frameworks
Your device model and iOS version
Apple permissions and entitlement availability
Screen Time settings
App Group and extension behavior
Network connectivity for synced household features
Whether the app remains installed and authorized
Whether the operating system allows the requested behavior
Nightset does not guarantee that shields will block every app, category, website, notification, device behavior, or user action in every circumstance.
You remain responsible for your own device use and for any household rules you set.
Nightset is not responsible for failures caused by device settings, OS changes, revoked permissions, Apple limitations, user workarounds, uninstalls, device resets, downtime, third-party service outages, or unsupported configurations.
9. Family and Household Features
Nightset may offer Household features for family bedtime coordination.
Household features may allow a parent or authorized adult to:
Create or join a household
Add members using a join code
Set a Lights Out status
Assign wake times for child devices
View member roles
Receive alerts if a child device stops checking in
Coordinate family bedtime routines
Nightset’s family tools are intended for wellness and bedtime coordination, not surveillance.
You agree not to use Nightset to unlawfully monitor, control, coerce, stalk, harass, punish, or surveil another person.
If you set up Nightset for a child, you represent that:
You are the child’s parent, legal guardian, or otherwise legally authorized adult
You have the required consent to use the feature
You will use the feature lawfully and responsibly

Nightset is not designed to read messages, monitor browsing content, view photos, listen to calls, track precise location, or inspect private content.
10. AI Coaching and Generated Content
Nightset may provide AI-generated coaching insights using third-party AI services such as Anthropic’s Claude API.
AI coaching is intended to provide short, general wellness reflections based on limited Nightset context, such as Night Score, streak, level, wind-down timing, breather count, and recent score history.
AI-generated insights may be inaccurate, incomplete, delayed, unavailable, or inappropriate for your circumstances.
You agree that AI coaching:
Is not medical advice
Is not mental health advice
Is not diagnosis or treatment
Is not a substitute for a doctor, therapist, sleep specialist, or other professional
Should not be relied on for emergencies or serious health decisions
If you have a medical condition, sleep disorder, mental health concern, or emergency, contact a qualified professional or emergency services.
We may modify, limit, suspend, or discontinue AI coaching at any time, including because of cost controls, provider limits, safety concerns, or technical issues.
11. Health and Wellness Disclaimer
Nightset is a wellness app. It may help you reflect on habits, routines, sleep consistency, and late-night screen use.
Nightset does not guarantee:
Better sleep
Reduced screen time
Improved health
Improved mental health
Specific productivity outcomes
Family compliance
Child compliance
Subscription value for every user
Continuous or error-free shield enforcement
Your results may vary.
Do not disregard medical advice or delay seeking professional care because of something shown in Nightset.
12. Wake Alarms and Notifications
Nightset may provide wake alarms, reminders, prompts, push notifications, and family alerts.
You understand that notifications and alarms may fail, be delayed, or behave differently due to:
Device settings
Focus modes
Silent mode
Notification permissions
Alarm permissions
Battery state
Network connectivity
Apple system limitations
iOS version differences
App deletion or force quitting
Third-party service downtime
Nightset should not be your only alarm or emergency reminder for critical obligations.
13. Soundscapes and Audio Content
Nightset may include soundscapes, guided sessions, or other audio content.
You may use Nightset audio only for personal, non-commercial use through the app. You may not copy, redistribute, record, resell, remix, extract, upload, publish, or commercially exploit Nightset audio unless we give written permission.
Some audio may be licensed from third-party providers and may be subject to additional restrictions.
14. User Content
Nightset may allow you to enter content such as notes, goals, routines, household names, wake-time entries, or similar information (“User Content”).
You retain ownership of your User Content, but you grant Nightset a limited license to use, process, store, display, transmit, and analyze it as needed to operate, improve, secure, and support the Service.
You agree not to submit User Content that:
Violates any law
Infringes intellectual property rights
Contains threats, abuse, harassment, hate, or exploitation
Contains sensitive information about another person without authorization
Contains medical emergency information that requires immediate response

We may remove, restrict, or refuse to process User Content if we believe it violates these Terms or creates risk.

16. Advertising, Attribution, and Marketing
Nightset may use advertising, marketing, analytics, and attribution tools, including Meta advertising tools, to measure ad performance and improve marketing.

You agree that Nightset may promote its services through advertising, referral campaigns, app store optimization, email, social media, and other marketing channels, subject to applicable law and your privacy choices.

18. Intellectual Property
Nightset, including its app, name, logos, design, interface, features, text, graphics, software, workflows, scoring systems, soundscapes, and content, is owned by GoldasDust Global Inc. or its licensors and is protected by intellectual property laws.
These Terms do not transfer ownership of Nightset or its intellectual property to you.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Nightset for personal or household use through authorized app stores and platforms.
You may not copy, modify, distribute, sell, lease, sublicense, create derivative works from, or exploit Nightset except as allowed by these Terms or applicable law.
19. App Store and Apple Terms
If you download Nightset from the Apple App Store, the following terms apply:
These Terms are between you and GoldasDust Global Inc., not Apple.
GoldasDust Global Inc. is solely responsible for Nightset and its content.
Apple has no obligation to provide maintenance or support for Nightset.
Your license to use Nightset is limited to a non-transferable license to use the app on Apple-branded products you own or control, as permitted by Apple’s usage rules.
You must comply with applicable Apple Media Services Terms and Conditions.
If Nightset fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, according to Apple’s rules. To the maximum extent permitted by law, Apple has no other warranty obligation for Nightset.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.
You represent that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. government prohibited or restricted party list.
20. Third-Party Services
Nightset may rely on third-party services, including Apple, Google/Firebase, Anthropic, Meta, RevenueCat, cloud hosting providers, analytics providers, customer support providers, and other vendors.
Your use of Nightset may also be subject to third-party terms and privacy policies.
We are not responsible for third-party services that we do not control. Third-party service interruptions, restrictions, pricing changes, policy changes, API changes, or outages may affect Nightset.
21. Availability, Changes, and Beta Features
Nightset may change over time. We may add, modify, limit, suspend, or discontinue features, plans, content, countries, rewards, points, integrations, or support for devices and operating systems.
Some features may be experimental, beta, limited-release, or available only to certain users, plans, countries, devices, or iOS versions.
We do not guarantee that any feature will always be available or that historical app behavior will remain unchanged.
22. Security
You agree not to test, scan, attack, bypass, or interfere with Nightset security systems without written permission.

23. Suspension and Termination

We are required to do so by law, Apple, a platform provider, or another authority

Termination does not automatically cancel an Apple subscription. You must cancel subscriptions through Apple.

24. Disclaimers
To the maximum extent permitted by law, Nightset is provided “as is” and “as available.”
We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, uninterrupted operation, and error-free performance.
We do not guarantee that:
Nightset will always work
Shields will always engage or release correctly
Alarms or notifications will always arrive
AI insights will always be accurate
Sleep outcomes will improve
Household members will comply
Data will sync instantly
Subscriptions will be uninterrupted
The Service will be free of bugs, outages, or third-party failures
Some jurisdictions do not allow certain warranty disclaimers, so some disclaimers may not apply to you.
25. Limitation of Liability
To the maximum extent permitted by law, GoldasDust Global Inc. and its officers, directors, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost sleep, missed alarms, missed obligations, device issues, subscription issues, family disputes, health outcomes, or loss of goodwill.
To the maximum extent permitted by law, our total liability for any claim relating to Nightset or these Terms will not exceed the greater of:
The amount you paid to Nightset for the Service in the 12 months before the claim, or

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
26. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless GoldasDust Global Inc. and its officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to:
Your use or misuse of Nightset
Your violation of these Terms
Your violation of law
Your violation of another person’s rights
Your User Content
Your household setup or family-control use

Your attempt to bypass subscriptions, security, or app systems
27. Governing Law
These Terms are governed by the laws of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-law rules, unless the laws of your location require otherwise.
If you are a consumer, you may have mandatory rights under the laws of your country, province, state, or region that cannot be waived by these Terms.
